'Constitutional crisis' looming over Obama's birth location

haysus here is a case filed by a democrat Phillip berg. if his does have a legit birth certificate why not just produce it, it would end all this bs.  I never said anything about a conspiracy, no more like lies, fraud and deception! All he has to do is produce the paper work! what is so hard about that! hmmmmm!

 

 

U. S. SUPREME COURT AWAITS RESPONSE TO
BERG'S WRIT OF CERTIORARI
FROM OBAMA, DNC and Co-DEFENDANTS



(Lafayette Hill, Pennsylvania - 11/07/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama's lack of "qualifications" to serve as President of the United States filed a Writ of Certiorari in the United States Supreme Court on October 30, 2008, requesting review of the United States District Court, Eastern District of Pennsylvania, Judge Surrick's Dismissal of Philip J. Berg's lawsuit against Barack H. Obama, Jr., the DNC and the other co-Defendants. Accordingly, the U. S. Supreme Court has set dates in which Barack Obama, the DNC and all co-Defendants are to respond to the Writ, which is on or before December 1, 2008.

Mr. Berg remarked today, "I look forward to receiving Defendant Obama's response to the Writ and am hopeful the U. S. Supreme Court will review Berg v. Obama. I believe Mr. Obama is not a constitutionally-qualified natural-born citizen and is ineligible to assume the office of President of the United States."

Mr. Berg's case, Berg vs. Obama was dismissed from the United States District Court for the Eastern District of Pennsylvania, Docket # 08-cv-4083 for lack of standing. Mr. Berg filed a Writ of Certiorari for review of the case and an injunction to stay the election pending review. Justice Souter denied the injunction. It is expected that the Court will decide whether or not to review Berg v. Obama after the Defendants file their response, and Mr. Berg has replied to the Defendant's response.

The Defendants' response is due by December 1st and Mr. Berg's reply will be submitted thereafter.

He has. He has provided what the state of Hawaii issues for birth certificates. They've certified it as authentic. Are you implying that the state of Hawaii is in on the scam? That they're in cahoots with a foreigner trying to seize control of the most powerful office in the world? That's quite the accusation when you think about it.

You're right about that and you're welcome to ask as many questions as you like. But continuing to ask the same question after it's been answered multiple times by multiple sources doesn't mean you're a patriot. It means you're simply being willfully obtuse.

When Berg, an ardent Clinton supporter, originally filed his case just prior to the Democratic Convention, he stated: "I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated." Maybe you can refresh my memory with a WorldNetDaily article or some other equally reputable blog post, but I don't remember seeing or hearing where McCain or Palin or even the RNC raised the issue of Obama's citizenship. I'm sure it was just an oversight on their part, right? I mean, if the man's got citizenship issues I'm sure the RNC or the McCain campaign would have brought it up, no? And now that Obama is the President-elect I'm sure the RNC is going to file their own suit over Obama's eligibility to serve based on his citizenship, right? They're just waiting for the right moment, I guess.

IF the allegations were true, the RNC, the McCain campaign, and all elected Republicans (like Ron Paul, maybe) would be all over this. But they're not. That should be all the proof you need. Unless, of course, you believe the Republicans are in on the scam too.

It’s Official: Obama “Born in the U.S.A.”

Of all the nutty rumors, baseless conspiracy theories and sheer disinformation that we’ve dealt with at FactCheck.org during campaign 2008, perhaps the goofiest is the claim that Barack Obama is not a “natural-born citizen” and therefore not eligible to be president under the constitution.

This claim was first advanced by diehard Hillary Clinton supporters as her campaign for the party’s nomination faded, and has enjoyed a revival among John McCain’s partisans as he fell substantially behind Obama in public opinion polls. There has never been anything but rumor and speculation to support such a claim, and zero hard evidence. When Obama produced a “certificate of live birth” from the state of Hawai, doubters simply claimed it was forged and continued to huff and puff. Lawsuits were filed (and dismissed). Blogs blogged on. Our own “Born in the U.S.A” article, showing close-up photos of the document complete with official signature and raised seal, got more page views than any other article this week, even though we posted it back in August. It is a document that would satisfy the State Department’s requirements for proof of citizenship for purposes of getting a passport. But not, of course, those who wish to believe otherwise, whatever the evidence.

Now, there is even less reason to doubt that Obama was born when and where he has always said. We posted this update to our Born in the U.S.A article:

Update, Nov. 1: The director of Hawaii’s Department of Health confirmed Oct. 31 that Obama was born in Honolulu. . . . The Associated Press quoted Chiyome Fukino as saying that both she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama’s original birth certificate.

Fukino also was quoted by several other news organizations. The Honolulu Advertiser quoted Fukino as saying the agency had been bombarded by requests, and that the registrar of statistics had even been called in at home in the middle of the night.

Honolulu Advertiser, Nov. 1 2008: “This has gotten ridiculous,” state health director Dr. Chiyome Fukino said yesterday. “There are plenty of other, important things to focus on, like the economy, taxes, energy.” . . . Will this be enough to quiet the doubters? “I hope so,” Fukino said. “We need to get some work done.”

We say, “amen” to that. You can take it from Hawaii’s officials: Obama was born in the U.S.A.

Berg Gets Sunk

Readers have been champing at the bit to know our view of the lawsuit brought against Obama by a Philadelphia Hillary supporter, which alleges that the candidate is not a natural-born U.S. citizen. (We know — this again?) Of course only a judge is qualified to legally determine the validity of a suit, so we’ve held off on opining, though we’ve certainly put forth our findings on various aspects of the claim. But we stress that there are no such qualification requirements to bring a suit. You don’t have to be a judge, or a lawyer, or a person who’s familiar with the law. You don’t have to have a valid case, or the authority to sue. You don’t have to have evidence. You need those things to get your case heard, and to win, but not to file. The filing of a suit proves only that a suit has been filed.

As it turns out, this one got no further. District Judge R. Barclay Surrick rejected the case last Friday. Importantly, though, Judge Surrick dismissed it based on the finding that Berg didn’t have standing to sue. (”Standing” is the legal authority to bring a case, which is usually tied to having a sufficiently personal stake in the issue at hand). Surrick didn’t rule on whether Obama is a United States citizen, because the suit didn’t get that far. Instead, it was tossed out on the same grounds as Hollander v. McCain (which alleged that McCain was not a natural-born citizen because he was born in the Panama Canal Zone) and Jones v. Bush (which stated that Bush-Cheney could not win Texas’ electoral votes because they were both Texas natives).

Many readers have asked why Obama didn’t show up in court with his birth certificate, if he is really a citizen. Obama and the DNC had instead filed a motion to dismiss the lawsuit, which, when it works, is usually the most efficient and least expensive way to dispose of a case. McCain didn’t present his documentation in the Hollander case, either. (As we’ve written, the claims turned out to be legally bogus.)

Because the judge didn’t address the merits of Berg’s claims, some may be left wondering about his evidence. We can offer that Berg’s complaint cites only the following sources for his charge that Obama is perpetrating massive identity fraud:

Wow. Talk about a thick head. Hawaii's Dept. of Health does not release the doctor-signed copy. Instead they release the form you've seen in all of the photographs. It's not uncommon for states to do this. Case in point, none of my children's birth certificates have a doctor's signature, either. Some states still release doctor-signed copies, however, most states have gone to a computer database and only release certified copies like the one produced for Obama. In fact, I believe the state of Hawaii went to that system just within the last ten or fifteen years and has even revised the form since then, hence the notation "OHSM (Rev. 11/01) LASER." Of course, the first article that I linked to states just that:

"When we asked about the security borders, which look different from some other examples of Hawaii certifications of live birth, Kurt said "The borders are generated each time a certified copy is printed. A citation located on the bottom left hand corner of the certificate indicates which date the form was revised." He also confirmed that the information in the short form birth certificate is sufficient to prove citizenship for 'all reasonable purposes.'"

But that probably requires that you actually read the article and not just stick your head in the sand and pretend that what you want to believe is true. I'm sorry if you're still stuck in the stone age, bigbrother, but the rest of the world has moved on. Maybe it's time you got on the bus and joined us.


Man, haysus...you sure are driving this into the dirt...without any success! That's the exact date I alluded to, haysus. Revision of the form means nothing. And that is NOT the original birth certificate. How come? If one exists, why is it so hard to present? As for your bus? I could never get on it...you liberals would make me sit in the back; and besides...its going over a big cliff very soon anyway!
