I think pre-meditated murder may be a stretch there daryl. I'm sure you could ask any drunk driver who killed an innocent victim, if they thought about killing that particular person before they did it. I'm pretty sure 99.9 percent of them would say no. So I think you can forget about it ever being pre-meditated. While I'm in no way saying they should get off easy, the death penalty for a 1st offense drunk driver is ludicrous. While you're at it, why don't you suggest charging the bartender that served them, with accessory to commit murder?
I don't see how you could ever be charged with anything worse than involuntary manslaughter, at least for the 1st offense. The sentencing should be a lot stricter for drunk drivers involved in fatalities no doubt, especially for multiple offenders.
If you want to put bad people to death, why don't you start a petition to kill crackheads on site, I could really get behind that one. lol |

He knew he was drinking. He knew what drinking does to him. He knew he was getting into a car. He knew that the car, in the hands of a drunk, becomes a 2000 pound killing machine. He knew that he put the key in the ignition, and started 'er up. He knew that it is against the law to drive while intoxicated.
It all sounds fairly premeditated to me, and until enough innocent people in my family, your family, in judge's families, and in lawmakers families are killed, I suppose we won't see any real effective changes in these fairly ineffective laws. By your logic, the crackheads are merely victims of their own upbringing and should get our pity and aid rather than being punished for their crimes.
Unfortunately, as things stand now, you're probably right.

Pre-meditated murder means you actually planned to kill someone. I'm sure most people who get drunk, and drive, don't plan on killing someone. I agree that it's a an all too common occurence, but the death penalty for this crime is too harsh in my opinion. What if it were a 17 yr. old kid driving after a party at a friends house, he/she gets a drunk, no real world experience being drunk, drives away and kills someone. Would you want your child killed for a big, but unplanned mistake? How about this, go back to prohibition, no readily available alcohol would lessen the amount of drunks quicker than anything else I know of. Seeings how I am not a drinker, this would cause me no problems at all.
I really meant in the last post, that all meth makers should be shot on site. With that said, how would we deal with underage offenders? Really, in my opinion, anybody at the dope dealing level, should be dealt with very, very harshly. I'm not talking about pot either, hard core stuff like meth, and coke etc. |
