Why I don't accept the "Wave-Through"

About 20 years ago or so, I had just purchase my first automobile. By that, I mean one I paid for, not one my parents had bought for me and my brothers to use. I had this car for just two weeks when the following happened:


I was driving east on Locust street in Davenport, approaching the intersection of Locust and Washington. I was in the right lane. As it was rush hour, there was a long line of cars in the left lane waiting. A driver heading west on locust signaled that he wanted to turn left to get into the gas station. One of the cars in the left lane waived this guy to turn, oblivious to the fact I was coming up on the right. The collision totaled my new car. If it were not for seat-belts, I'd have sustained serious injury. The driver that hit me stated he'd gotten a "Wave-Through" from a car in the left lane. Of course that person left the scene of the accident. The police officer said that it is illegal to wave-through. He went on to say that it is like you're impersonating a police officer when you do that. I've never forgotten that.

According to Iowa Code: 321.256  Obedience to official traffic-control devices:
"No driver of a vehicle shall disobey the instructions of any official traffic-control device placed in accordance with the provisions of this chapter, unless at the time otherwise directed by a peace officer subject to the exceptions granted the driver of an authorized emergency vehicle. "

Simply stated it means, "OBEY THE SIGNS!" When you direct people through, you are impersonating a peace officer.


There is a rash of courtesy at our numerous 4-way stop intersections in Muscatine and I wish for it to cease. Just the other day I was at the corner of 8th and Mulberry. I was heading west and signaled I would be turning left to head south on Mulberry. A driver who was at the intersection well before me, heading west on 8th started to wave me through. I stayed put. He waved and waved and I stayed put. Look, I'm not going to proceed, sir. You have the right of way. Get moving. Boy, you should have seen the look he gave me.

There have been lawsuits filed against people that wave-through when an accident resulted. It's against the law. Please, people, quit waving and starting driving! Yell

Once again, Noloh, you are misinforming the public. You are not an authority on the matter. For you to say someone is impersonating an officer is nothing mnore than YOUR opinion. Will you please quit misinforming people here?

 

Please, please, please...tell all these prople you have committed to, why a simple courtesy of yielding the ROW is against the law. Please be specific and please cite the section of Iowa code that prohibits anyone from yeilding their ROW to another driver!!!  Not the section for impersonating an officer....because that is an entirely different matter.

 

Secondly, please cite the legal recitations of the lawsuits that you have posted about that have been filed against people for the waive-thru factor for this. I can't seem to find any online in Iowa where this matters, as you state.

 

Why is it you state that waive-thru is against the law?

Sorry...I guess my best information is, how is it you consider ***people*** to be an "official traffic control device", when they simply waive people though?

 

Have you looked up the IOWA definition of "official traffic control device"? Is that what people are? I don't think so, pal....

 

Again...please cite why is it illegal to yeild your ROW and signal other drivers by waive-thru?

One additional proposal on the matter. If you have an accident as a driver with another vehicle in Iowa, you are required to stop and render aid; or summon medical aid as appropriate, if injured.

 

What if that aid involves directing traffic around an accident victim lying on the highway who has been hurt? Since the Iowa accident code relates that fact as law, how can you say, that act would be impersonating an officer? You have to render aid by law if involved in an accident....so how does Noloh protect the accident victim laying on the highway if traffic has to be directed around them to save their lives? 

 

Is Noloh complying with the state accident code or is he in violation like hetries to misinform readers here?

 

So...how do we make the leap to simple waiving-thru of traffic at an intersection as impersonating an officer? WOW!
